XIV. Policy on Outside Professional Activities (Moonlighting)
Because residency education is a full-time endeavor, the program director must ensure that moonlighting does not interfere with the ability of the resident to achieve the goals and objectives of the educational program.
A. Each MSU/CHM Sponsored Residency Program must have a policy on Moonlighting and each resident and faculty member participating in the Program must be provided with this policy. A written (or electronic) permission from the Program Director must be made part of the resident’s file. Residents must not be required to engage in moonlighting. Program Directors may prohibit residents from moonlighting if at any time moonlighting impairs resident educational performance or for any of the following reasons:
1. Resident is not satisfactorily progressing in his/her program.
2. Resident has not attended a satisfactory percentage of mandatory conferences.
3. Resident is delinquent in his/her medical records.
4. Resident has not completed a satisfactory percentage of required evaluations.
5. Resident is noncompliant with Residency Program policies.
6. Other issues that, in the judgment of the Program Director, provide a reasonable basis on which to deny the resident moonlighting permission.
B. Resident performance will be monitored by the Program Director for the effect of moonlighting activities upon performance and adverse effects may lead to the withdrawal of permission to moonlight.
C. Some Institutions where MSU/CHM residents are based also have moonlighting policies. It is the resident’s responsibility to familiarize him/herself with such policies and to comply with them. If there is a conflict between MSU/CHM’s policy and the policy of the Institution, the more restrictive policy controls. Note: Such policies often preclude PGYI residents from engaging in any outside professional activities.
D. Residents who engage in outside professional activities (moonlighting) are not covered by MSU, Hospital, or Program professional liability insurance.
E. Residents must possess a valid Michigan Educational Limited License to Practice Medicine and must engage in outside professional activities at only the institution(s) that are designated by that license.
Moonlighting that occurs within the residency program and/or the institution or the non-hospital sponsor's primary clinical site(s), i.e., internal moonlighting, must be counted toward the 80-hour weekly limit on duty hours.
